- Title
THE CONSTITUTIONALITY OF SCHOOL PRAYER: OR WHY ENGEL V. VITALE MAY HAVE HAD IT RIGHT ALL ALONG.
- Authors
MARSHALL, WILLIAM P.
- Abstract
The author discusses the invalidation of public school prayer in the U.S. as per the 1962 Engel v. Vitale case decision which invoked sectarian divisiveness and the corruption on religion. Topics covered include the focus on individual harms like coercion and alienation in later school prayer cases, and the issue's continuing controversy in 2018. The author cites the amorphous and sound concerns, respectively, on individual harm and religious divisiveness, as bases for the First Amendment.
