- Abstract
The article discusses the application of the duty to disclose to irrevocable trusts in the U.S. It reexamines the development of the duty to disclose such as the settlors' provision of information to beneficiaries as well as the Uniform Trust Code (UTC) approach. It analyzes the policy concerns under the mandate of disclosure and the permission of nondisclosure. It concludes on the significance of a surrogate to be appointed to receive trust information on behalf of the beneficiaries.
