- Abstract
The article explores the power of the U.S. Department of Justice (DOJ) to settle and dismiss qui tam lawsuits authorized by the False Claims Act (FCA). Topics discussed include the economic incentives that motivate citizens to report fraudulent actions committed against the government, the decision on the U.S. District of Columbia Circuit Court case Swift v. United States which concerns the dismissal of qui tam suits, and the susceptibility of the DOJ to regulatory capture.
