- Abstract
This paper addresses the issue of responsible litigation as a prerequisite to be observed in lawsuits concerning the provision of health services provided by the government. The research highlights the current crisis of the Brazilian Judiciary, indicating as causes, among others, the high number of cases, the delay in the finalization of the procedures and the existence of an institutional environment that encourages litigation, even in cases of doubtful necessity. Together these causes prevent or hinder an adequate jurisdictional provision in cases that have as their object the right to health. The article concludes that the establishment of a culture focused on responsible litigation is capable of helping the rational use of the Judiciary, thus contributing to overcoming the current crisis. As for the methodology, this text constitutes a bibliographical study (doctrine) and jurisprudence, with a qualitative approach and with conclusions drawn primarily through induction.
