- Title
Underinsured Coverage Extended to Insured's Vehicle.
- Authors
Darr, Frank P.
- Abstract
The article focuses on the decision of the Ohio Supreme Court on the case involving the underinsured coverage to the insured vehicle involved in an accident. The court considers that the exclusion of coverage for the insured's own vehicle involved in an accident has violated the state law. However, in the state statute mandating coverage, extended coverage to persons entitled to recover damages from the owner or operator of a vehicle. With this regard, the court concluded that the policy can not deny coverage since the basic requirement for tort liability was satisfied.
