- Abstract
In January 2020, the Chilean Supreme Court revoked the leniency benefit that the National Economic Prosecutor's Office granted to a leniency applicant and the Chilean Competition Court acknowledged, by exempting the applicant from the fine associated to the infraction. This article focuses on the leniency program, its requirements and the consequences of the recent ruling of the Chilean Supreme Court for the future of the leniency programs. Among these consequences, whether the revocation of the leniency benefit could increase the exposure of the leniency applicant to follow-on actions affecting the incentives to cooperate will be analyzed.
