- Abstract
The Ottoman Empire which is the sui generis model of the pre-modern power forms has huge transformations since the era of Mehmed II (The Conqueror) in order to gain an imperial aura. The lawbooks (Kanunnamahs) which were codified and systematized in his era is one of these huge transformations. When these kanunnamahas, known as Fatih Kanunnameleri in Turkish, are examined some findings on the source of authority and power can be detected. The Ottoman Empire can be defined as a theocratic state since the source of its power comes from the divine arguments. Yet, given the implementations there some cases in which the source of authority is the order (authority) of the sultan. This problematic is developed around whether the kanunnamahs have secular character or theocratic one. While some scholars and thinkers argue that the kanunnamahs are theocratic referring to the source of the power, some other scholars and thinkers offer they are secular due to the case of the authority in the practices of the monarchs. This study proposes, through a neology, the theolaicity of the kanunnamahs considering the political ontology of the monarchy in the Classical Islamic tradition of politics.
