- Abstract
I consider that the classification and organization of penitence insitutions where the convicted individuals stay does not guarantee an appropriate sentence punishment. Therefore, with the help of this work I will not only try to present the situation from a critical approach, but I will also offer numerous solutions and suggestions which would highly contribute in the improvement of the condition of penitence institutions. In addition to this, I will also suggest ways out how to improve the conditions of serving a sentence punishment. My proposals and suggestions are based on lawful solutions and the rich experience of democratic countries in Europe and elsewhere. Another reason which made me propose this topic was the fact that in the Republic of Macedonia the constitution, positive laws, the human rights are not respected. Moreover, citizens are arrested, maltreated and the laws of serving a sentence punishment, the laws of community sentence and resocialization, the laws of putting an end to torture and maltreatment and the laws of post-punishment help are not respected at all!. The beginning of this work presents the historical background and the legal basis of the treatment of convicted individuals in the Republic of Macedonia. Later on, this work lists the legal acts of criminal sanctions (Penal Code of Republic of Macedonia, the law for the execution of criminal sanctions, the law for criminal procedure) as well as the organization of penitentiary institutions - workhouses in our country.
