- Abstract
The article focuses on hardrock mining and Good Samaritan legislation in the U.S. The advantages and shortcomings of Good Samaritan legislation as a solution to the problem of remediating abandoned mines are identified. It examines whether federal law already contains sufficient liability relief provisions to address the concerns of Good Samaritans. The possibility of utilizing administrative procedures and orders that could be tailored to specific Good Samaritan cleanup efforts, such as model documents released by the U.S. Environmental Protection Agency (EPA), is addressed.
