Everyman's Exclusionary Rule: The Exclusionary Rule and the Rule of Law (or Why Conservatives Should Embrace the Exclusionary Rule).
- Authors
Sundby, Scott E.
- Abstract
An essay is presented on viewing the exclusionary rule through the principles of the rule of law in the U.S. The author explains why conservatives and everyone who believes in the constitutional system should support the exclusionary rule. Professor Christopher Slobogin's argument about the use of exclusionary rule to deter police misbehavior is discussed. The Supreme Court's view that the rule is necessary to perform its constitutional duties under the separation of powers is also discussed.
