- Abstract
as a result of the globalization process, there is an asymmetry between the international corpus iuris of human rights and the internal regulations of fundamental rights. Although globalization tends towards homogenizing law and culture, it simultaneously implies disregard for cultures and socio-legal identities. With a descriptive-propositional method, we take the premise that “the application of human rights is universal” and propose measures that harmonize the supranational plane with the anthropological, historical, and cultural recognition of the human inhabitant from a multicultural dimension of legal expressions. For this, two alternatives are provided: a) from a micro perspective, the application of the dialogical model to achieve an intercultural dialogue, starting from the existing incompleteness and weaknesses between cultures to arrive at the phenomenological construction of collective consciousness; b) at the macro-state level, the establishment of ascending inter-judicial dialogues from national judges to international courts belonging to regional systems that protect human rights.
