- Abstract
This article focuses on the judicial decision made by the Oregon court against the case "Welbourn v. Firemen's Insurance. Co., 458 P. 2d 167," concerning uninsured motorist claim contributions. In the case, the insured, who was injured in a collision involving two uninsured motorists, had obtained judgment against one of them which was fully satisfied and the insured first sought to arbitrate and then brought an action. The court found that insurer was not liable under uninsured motorist endorsement for damages allegedly caused by the other motorist. In reaching its decision, the court first determined that the policy required that no judgment against any person or organization alleged to be responsible shall be conclusive as between the insured and the company and concluded that the discharge or satisfaction of a judgment against one of several persons, each of whom is liable for a single harm, discharges the others from liability therefore.
