The article examines the role of the objective and jurisdictional framework in determining abusive filings under the Chapter 11 of the Bankruptcy Code in the U.S. Topics mentioned include the status of the good faith filing requirement during the New Deal era and in 1978, the comparison of the judicial requirements for filing a corporate reorganization bankruptcy proceeding, and a description of court cases in which the Chapter 11 was dismissed.
