An essay is presented in which the author discusses decision of the U.S. Supreme Court on the case Kawasaki Kisen Kaisha Ltd. v. Regal-Beloit Corp. related to violation of the Carriage of Goods by Sea Act (COGSA). Topics discussed include the role of COGSA in imposing liability on carriers on loss or damage of cargo, the role of Carmack Amendment to the Interstate Commerce Act in governing rail carriages in the U.S., and the judicial opinion on the case Norfolk Southern Railway Co. v. Kirby.
