IS THERE A BORDER EXCEPTION TO THE EXCLUSIONARY RULE?
- Abstract
The article discusses whether a U.S. exclusionary rule of evidence applies to searches that are conducted at the American border, and it mentions legal exceptions, rulings issued by the U.S. Supreme Court, and the search-related policies and procedures of the nation's U.S. Customs and Border Protection. The Fourth Amendment to the U.S. Constitution is mentioned, along with American jurisprudence. The benefits of deterrence are examined in relation to the social costs of excluding evidence.
