- Abstract
The article analyzes whether state oil and gas laws preempt local communities from regulating fracing within their own boundaries in the U.S. It describes the history and nature of the home rule, self-government of local affairs in a political entity which is within the control of a country, and reflects on concerns related with fracing. It discusses the West Virginia court case Northeast Natural Energy LLC v. City of Morgantown which was concerning preemption of legislative power.
