- Title
3.0 REGULATION OF PRICE COMPETITION.
- Authors
Werner, Ray O.; Tower, C. Burk; Reid, Brad
- Abstract
The article presents legal developments in marketing with particular focus given to the regulation of price competition. One of the developments describes the case of Richard Short Oil Co. Inc. v. Texaco Inc., which shows that price discrimination is not illegal if it does not hinder competition or cause harm to a competitor. Another development describes the case of The Garment District Inc. v. Belk Stores Services Inc., which clarifies that a manufacturer's termination of a discounting retailer after severe economic pressure exerted upon the manufacturer by other retailers does not constitute a conspiracy to fix prices.
