- Abstract
The article presents legal developments in marketing relating to the regulation of unfair competition. Regarding advertising, the United States Federal Trade Commission's (FTC's) Enforcement Policy against Deceptive Acts or Practices is discussed, including an outline of the requisites for FTC enforcement. A case involving Reader's Digest Association, Inc. and the nullification of a prior FTC cease-and-desist order is also discussed. Regarding trademarks and trade names, the case Ohio--Sealy Mattress Manufacturing Co., Sealy Mattress Company of Houston, Sealy Mattress Co. of Fort Worth, Sealy Mattress Co. of Puerto Rico, Inc., Sealy of the Northeast, and Sealy Mattress Co. of Georgia v. Morris A. Kaplan, Sealy Mattress of Illinois, et al. is also discussed.
