- Abstract
The article discusses issues in environmental justice by examining the case Friends of Buckingham v. State Air Pollution Control Board, in which the U.S. Fourth Circuit ruled that the decision to issue a permit as capricious and arbitrary. In the ruling, the court claimed that the Virginia State Air Pollution Control Board failed to do a proper environmental analysis under the Commonwealth Energy Policy in adopting the state Department of Environmental Quality (DEQ) recommendations.
