- Title
A Call to Counter Repressive Legalism: Addressing the Implications of SFFA v. Harvard.
- Authors
Ngaosi, Nicole C.; Garces, Liliana M.
- Abstract
The article discusses the recent U.S. Supreme Court decision in Students for Fair Admissions, Inc. v. President and Fellows of Harvard College and Students for Fair Admissions, Inc. v. the University of North Carolina-Chapel Hill, which further restricted the consideration of race in college admissions processes. The decision has significant implications for racially minoritized students, who often face greater challenges in accessing educational opportunities compared to their white peers. The authors argue that this decision reflects a broader trend of repressive legalism, where external pressures lead educational professionals to suppress equity-oriented policies and practices. They emphasize the importance of countering these pressures and providing guidance to higher education administrators and student affairs practitioners to ensure equal treatment and promote nondiscrimination.
