- Abstract
Penal mediation is an activity based on the logic of negotiation, whose purpose is not only to manage the legal situation in breach, but also to settle the social relations between the individuals involved. Juvenile penal mediation enables the juvenile perpetrator and his victim to contribute pro-actively to managing the conflict in which they are opposed to one another. In the light of the results of research that are summarised in the article, it appears to be possible to state that mediation enables a space to be opened in the trial proceedings for the victims, which would otherwise be denied to them. In practice, juvenile penal mediation has provided both perpetrators and their victims with an opportunity to express themselves and be acknowledged. It therefore lends itself to act as a test-bed for social participation, especially in cases where it is practised between equals.
