- Abstract
In order to decide the termination it is necessary to exist also a default without justification of the obligation by the debtor under para (2) of art. 1.516 NCC. The phrase „without justification” in para (2) determines the activation in favor of the creditor, of the rights mentioned in art. 1.516 NCC, to the extent that the debtor does not prove the existence of certain exoneration causes such as force majeure, act of God, non-performance plea or deed of the creditor, it implicitly results the idea of guilt, which in terms of evidence is governed by the provisions of art. 1.548 NCC.
