- Abstract
The article examines the Bankruptcy Code developments and its effect on consumer welfare in the U.S. The Bankruptcy Abuse Prevention and Consumer Protection Act that President George W. Bush signed into law in April of 2005, presents a major hurdles to bankruptcy practitioners, petitioners and secured creditors. Comprehensive studies on the success rates of Chapter 13 plans would enable bankruptcy courts to develop objective formulas for calculating cram down rates.
