- Abstract
The article highlights concerns raised in the case Starkman v Evans, over the government intervention in church affairs and the employees, violation of the First Amendment and human rights and the subsequent penalties under antidiscrimination laws. It discusses the courts' analysis in the trials under the Americans with Disabilities Act and Title VII of the Civil Rights Act of 1964. It further suggests solutions to minimize the discrimination in the name of disability and the religion.
