The article compares the decisions of U.S. federal courts, the U.S. Supreme Court, and the Minnesota high court in employee retaliation court cases. It is suggested that Supreme Court decisions such as Crawford v. Metropolitan Gov't of Nashville and Davidson County have favored employee claimants while Minnesota court decisions such as Gagliardi v. Ortho-Midwest, Inc. have favored employers.
