- Abstract
The article focuses on the case between an employee Roger Eatherton and his employer Jet Plastica Industries Inc. in the U.S. In the case, it is pointed out that short-term disability benefits that are paid out of an employer's general assets are salary continuation benefits that are a payroll practice, not an employee welfare plan governed by Employee Retirement Income Security Act of 1974 (ERISA). ERISA does not govern programs that provide benefits for temporarily disabled employees for reasons such as pregnancy or psychiatric treatment.
