- Abstract
Although property insurance policies differ among insurers, most policy forms provide the insurer with a right to demand the examination under oath (EUO) of its insured and a right to demand records and documents supporting the claim. Effectively conducted, an EUO assists the insurer in reaching a fair coverage decision and allows the insured to explain the circumstances of the loss and to substantiate property value. But an EUO is not a routine deposition, and counsel is advised to review case law and rules unique to different jurisdictions that often govern procedural and substantive issues.
