- Abstract
The article argues that should the Indigenous communities and families of boarding school deaths seek relief through litigation, they possess valid wrongful-death or negligence causes of action under the U.S. Federal Tort Claims Act (FTCA). Topics include historical background of federal Indian policy, the establishment of residential schools and what life was like for Indian children at these schools; the enactment of FTCA; and the potential failure of claims and settlement possibilities.
