- Abstract
The article discusses the issue about communitarian challenge to the adversarial conception of legal dispute bargaining as the most important development in the legal bargaining literature. It is stated that communitarian bargaining faced critique of adversarial bargaining which is gratuitously belligerent, polarizes relationships, and retards social development. The article also talks about the normative and empirical case for communitarian bargaining.
