- Abstract
The article discusses a court case wherein the British Crown Court stated that first officer P. C. Kenny did not have objective grounds on the suspicion of an offence that can justify the initial arrest on appellant Ali. In the case Cumberbatch v. Crown Prosecution Service; Ali v. Director of Public Prosecutions, Cumberbatch appealed on the conviction of assaulting a police officer while executing her duty similar to the way Ali appealed by way of the case stating to Divisional Court their argument of not committing a breach on Police Act 1996 s. 89(2).
