- Abstract
The article focuses on the Citizens for Clean Government versus City of San Diego case in California. The plaintiff, Citizens for Clean Government "Citizens," was an incorporated association formed to recall a city councilman. The defendant was the City of San Diego whose ordinance bans any contribution over $250 to committee supports or opposes the city council candidate. The Ninth Circuit held that the duration of the challenged action was too short to be litigated before the cessation. Moreover, the burden of showing the state interests on the government, however, the city did not meet this burden because it showed hypotheticals with vague allusions to practical experience.
