- Abstract
The author comments on the nature of socio-economic rights guaranteed by the 1947 Japanese Constitution as written in articles by two Japanese professors in 1990. He points out that substantial aid is only available through statutes despite the welfare rights in the Constitution and discusses three theories to explain the nature of the welfare rights. The author questions the extent of government regulations on economic freedom and property rights and agrees with the use of the rationality test to determine a regulating measure's constitutionality.
