- Abstract
The article discusses about bankruptcy policy. It points out that bankruptcy policy is an issue of general concern that must first be handled before the special problems that arise by virtue of a bankruptcy proceeding are confronted. It addresses the problem of individual debtors who are unable to pay what they owe. It inquires whether the right of creditors to bring suit, reduce their claims to judgment and have the sheriff levy on or garnish assets should be limited by anything other than whether one has assets. It indicates that the decision of the U.S. Supreme Court in Commodity Futures Trading Commission v. Weintraub points to a possibility to imagine a world without bankruptcy law.
