- Abstract
The article discusses a court case of Marmet Health Care Center v. Brown related to the approval of arbitration agreements used for avoiding or minimizing the accountability of the negligence made by nursing homes, as stated by the U.S. Supreme Court. The use of mandatory pre-dispute arbitration agreements by the vulnerable population is discussed. The challenges faced due to the federal law, the Federal Arbitration Act, which offers protection to the nursing homes from judicial accountability in case of their ignorance of quality of care standards are also discussed.
