- Abstract
The article discusses the history of the doctrine of "implied account stated," an agreement implied between a creditor and a debtor based upon a series of prior transactions that a particular amount is owed to the creditor as of a certain date, in consumer debt collection process law of West Virginia, New York State, and Maryland. It analyzes the problems arising due to implied account stated and reflects that it is inconsistent with the notion that silence and inaction don't give assent.
