- Title
Bounded Legality: China's Developmental State and Civil Dispute Resolution.
- Authors
WOO, MARGARET Y. K.
- Abstract
This essay examines the development state of China and its civil dispute resolution. It illustrates the prognosis of Professor Chiu Hungdah that the Chinese legal system will continue to put emphasis on order over freedom, duties over rights, and group interests over individual interests using the Armillarisin A case. It also explores the path of Chinese legal reforms and the proposed amendments to the Chinese Civil Procedure Code that would codify a multi-track litigation system.
