- Abstract
The article argues that the U.S. Court of Appeals for the Ninth Circuit correctly interpreted Section 1252(G) of the Illegal Immigration Reform and Immigration Responsibility Act of 1996 in the case Arce v. U.S., while the Eight Circuit ignored Supreme Court precedent in Silva v. U.S. Topics discussed are removal and wrongful deportation claims under the Federal Tort Claims Act and the jurisdiction of federal district courts over deportation claim by undocumented immigrants.
