- Abstract
Most of the published empirical work comparing tort versus no-fault automobile compensation systems utilize U.S. data. For a variety of reasons, the Canadian experience may well differ from that in the U.S. These reasons include the availability of a universal health care system, a less litigious legal environment, and a greater emphasis on first-party coverage in Canada. In this paper, consideration is given to some of the differences between the Canadian and U.S. systems, from which two hypotheses are developed and tested. Results indicate that indeed the Canadian experience with no-fault is distinct from what is hypothesised by no-fault proponents and also from experience in some U.S. jurisdictions.
