- Title
Schmähkritik gegenüber Präsidenten einer Ärztekammer.
- Abstract
The article deals with a defamatory criticism towards the president of a medical association in connection with the fight against the coronavirus pandemic. A doctor expressed on the portal of the medical association that the professional representatives of doctors had allowed themselves to be corrupted and that it was fascism. The professional court has determined that the doctor committed a professional offense. It is stated that unfounded criticism of the treatment or knowledge of a doctor is contrary to professional ethics. The conviction is considered constitutionally justified, as the statements of the accused are seen as personal derogation and judgments. The professional court imposes a fine and a reprimand as an appropriate punishment for the professional offense.
