- Abstract
The article analyzes the disconnect between the duty to insure property and the duty repair property, the two competing duties that center in legal battles in casualty damaged condominiums in Florida. It looks at the states' statutory foundation for condominium insurance coverage and contractual duties of condominium unit owners and associations. It also examines the Plaza East case trilogy interpretation of the statutory duties which disregarded contractual duties.
