The article discusses the accuracy, transparency, and standing in foreclosures of Mortgage Electronic Registration Systems Inc. (MERS). It explores the various theories of the company's standing which include the actual ownership of a mortgage, a note, or both, U.S. Uniform Commercial Code (UCC) statuses, and equitable title, legal title, or both. It examines common public-policy criticisms of the company.
