- Abstract
The article focuses on how California's Proposition 46, the Medical Malpractice Lawsuits Cap and Drug Testing of Doctors Initiative, increases the risks of harm for patients due to an impaired physician. Topics include availability of the results of physician drug testing for criminal and civil litigation, a recommendation to identify physicians with substance abuse, and ambiguity of the initiative in terms of important components of an effective testing program.
