- Abstract
The article focuses on the phenomenon of mass arbitration and its impact on the civil justice system. It provides an overview of the rise of mandatory arbitration and the emergence of mass arbitration as a tool used by plaintiffs. It also discusses various responses to mass arbitration by defendants, such as dropping mandatory arbitration clauses, seeking relief from their own agreements, and trying to cut mass-arbitration counsel out of the picture.
