- Abstract
The article focuses on the role and importance of the structure of insolvency system in facilitating corporate reorganisation. It states that countries vary in the standards for initiating reorganisation proceedings and in the structural position of the reorganisation proceedings on the basis of bankruptcy. It explores the potential of the structure of the insolvency system to promote the reorganisation of business operators in settings where reorganisation is preferred over liquidation. It discusses how reorganisation of insolvent businesses can help prevent the liquidation of viable businesses.
