In this article, the author presents his views on the matter of judicial retention election. According to him, whether the judicial elections are contested, uncontested, partisan, nonpartisan, or yes/no retention, the empirical data is needed. He states that the question of the effect of retention elections on the capacity of state courts to enforce state constitutional rights is illogical because the retention elections insulate judges from voters.
