- Abstract
The international child abduction has now reached worrying proportions due to the process of European integration and the continuous increase of mixed marriages. Therefore, in order to combat the phenomenon of international child abduction, the States have adopted several international legal instruments. Among the numerous provisions adopted, the Hague Convention of 25 October 1980 on the Civil Aspects of International Child Abduction plays a leading role. According to the rules of such Convention, the judicial or administrative authorities of the Contracting States must ensure the prompt return of the child to the State of its/her habitual residence, if there are the conditions for the application of the Convention. However, the 1980 Hague Convention does not specify the scope of its provisions, for example with relation to the enforcement of return decisions emanated on its foundation. In this regard, an important role is played by the European Court of Human Rights The present paper analyses the decisions and judgments in which the European Court of Human Rights has clarified the content and limits of the obligations of the States Parties in the application of the 1980 Hague Convention.
