- Abstract
-This research has preserved for us the two missing books of Al-Madaini (d. 224AH), whichare “Al-Musayyareen” and “Al-Mugharrabeen” . -Reprehensible hadiths were narrated about cursing Al-Hakam bin Abi Al-Aas, and it is not permissible to invoke them; and that the Prophet, peace and blessings of Allah be upon him, with his forbearance and his indifference to what he hates, did that only for a great matter. It is said: Othman, may Allah be pleased with him, apologized when he brought him back to Al-Madina that the Prophet, may Allah’s prayers and peace be upon him, was asked permission for the matter, and Othman said: I had interceded for him, so he promised me that he would return him. - It is permissible to banish such effeminate people to a country that is secure regarding the corruption of its people. If they are feared for that, they will be imprisoned, this is not a matter of punishment, but rather a form of fear of immorality before it occurs . -The Islamic Sharia came to preserve the honor and blocked all the outlets that feared the symptoms of the Islamic society, including protecting the Muslim family from the entry of some of the men who were called in the tradition of the effeminates, and they were created with the behaviours of women, their dress, their speech and their movements without any affection, nor a tie. He has no interest in women at all, and this type of men is abnormal in its composition, but this abnormality is congenital and mountainous in it, and that is why some of these people used to enter upon women without denying them in that, but when some of them described women and stared at the charms and beauties of women, Islamic law prohibited them from entering to prevent sedition and block pretexts . -The fuqaha and others differed about what is meant by exile or banishment, and it is general in both male and female, except that the woman should have a mahram with her . -Banishment is to take him out of his country to another place, even if it is less than the short distance, and
