- Abstract
In a previous article, we have analyzed the provisions of Law No. 182/2002 on protection of classified information, and its implementing norms, in order to outline the cases when, in a too easily manner, the access to public information is restricted by a simple unilateral decision to classify information, made by a public authority or institution. Under this article, we will explore the difficulties that at this moment exist in relation to the judicial control over such unilateral decisions made by public authorities or institutions, in relation to classified information. Such difficulties have determined an effective reaction of Romanian courts of law, which openly and repeatedly criticized the current provisions of Law No. 182/2002, deeming them as un-constitutional. From this point of view, this article outlines a specific impediment resulting from the current provisions of Law No. 182/2002, which is relating to the very few number of judges currently authorized to have access to classified information, an aspect which is strengthening the critics on the current concept of classified information, which is deemed to support the abusive restriction of the access to public information.
