- Abstract
On 10 April 2014, the ECJ overturned on appeal two judgments by the General Court relating to a cartel sanctioned by the Commission in 2007 in the market for gas-insulated switchgear (GIS) projects. In the Siemens Österreich judgment, the ECJ ruled that it is for the national courts, and not for the Commission, to determine the shares to be paid by each of the companies held jointly and severally liable for the infringement. In the Alstom/Areva judgment, the ECJ ruled that, in case of succession of two parent companies, each of them must be in a position to infer from the decision the share of the fine corresponding to that imposed on the subsidiary which may be imputed to each of them.
