The article discusses various sources of community leverage which can be used to pressure industries to engage in benefit sharing arrangements in America, and it mentions tort actions filed by local governments, conflicts between state and local governments, and issues involving constitutional and common law legal claims. Zoning authority and corporate social responsibility are addressed, along with the political and legal aspects of hydraulic fracturing, mining, and hazardous waste sites.
